The new issue of DER STAAT has been published. It also includes an essay by Dr. Iva Kostov entitled "Preventive behavior prediction through 'artificial intelligence'. Possibilities, standards, mistrust." The article deals with the possibility of using it to predict criminal behavior in the German legal system. The starting point is the assumption that a general idea of technological risks and potentials alone is not sufficient for an appropriate legal assessment of such area-specific application constellations. Iva Kostov examines the technology in the context of crime-preventive behavior prediction and elaborates on the currently applicable legal standards for the use of the technology, with a particular focus on the relevant security law case law of the ECJ and BVerfG.
