Projektgruppe verfassungsverträgliche Technikgestaltung

The project group: Constitutionally Compatible Technology Design (provet) at the University of Kassel is carrying out interdisciplinary research projects, under the direction of Prof. Dr. Alexander Roßnagel and Prof. Dr. Gerrit Hornung, on the legal issues arising in the field of information and communication technology. The projects are being funded and promoted by ministries, other public authorities, foundations which promote research, enterprises and the German Research Foundation (DFG - Deutsche Forschungsgemeinschaft).

The first agenda of the research projects is to support the development of legally compatible technology. In a technically oriented society, the only way left of fulfilling objectives of the law, such as freedom or self-determination, legal certainty and legal protection, is to implement them in technical systems. It is also considerably easier and less expensive to make allowances for legal specifications during the development and design of technical systems, rather than having to subsequently alter the systems. Within the framework of practical research projects, concrete, technical design proposals are being developed for technical systems, such as ISDN units, signature algorithms, multimedia system models, electronic methods of payment, mobile commu­ni­cation, internet shops and electronic marketplaces. In this way, compliance with such legal requirements can be ensured. The second agenda of the research projects is to support technically appropriate legal training. In order for the legal functions to be fulfilled in the future, the law must be adapted to meet the changing general conditions specified by the development of technology. Conversely, especially in the case of information and communi­ca­tion technology, appropriate legal regulations have become a central requirement for its implementation. An additional goal of the research projects is to thus establish technically suitable regulation concepts and legal recommendations, like in the past, e.g. for signature law and tele-service data protection law, and a law for data protection auditing.

Since 1998, the project group "Constitutionally Compatible Technology Design (provet)" has continued the research work that provet e.V. has been conducting in Darmstadt since 1986. provet has been part of the Chair of Prof. Dr. Alexander Roßnagel since 1998. Since 2005 it has also been a department of the Research Center for Information System Design (ITeG) at the University of Kassel. provet has been headed by Prof. Dr. Alexander Roßnagel for 30 years. 

Since the 1st of May 2018, Prof. Dr. Gerrit Hornung, LL.M. has additionally taken over the management of provet. He was Managing Director of the project group from 2006 to 2011 and Professor of Public Law, IT Law and Legal Informatics at the University of Passau from 2011 to 2015. He has been a professor at the University of Kassel since 2015 and strengthens the ITeG's legal research in the field of technology. The joint management will continue provet's research approach and orientation at the University of Kassel in the future.
